Re: Strike on July 21

As you may know, C.N.A., the union representing UC nurses, has notified the university of its intent to hold a one-day strike on Thursday July 21, 2005. The university has also received a letter from CUE, the union representing clerical employees, indicating its intent to honor the C.N.A. picket lines. However, consistent with University of California past practice and policy, all employees are expected to come to work. Offices will be kept open and the campus will provide essential services.

TAPS will operate all available campus transit vehicles to accommodate the anticipated demand for shuttle services, as the Santa Cruz Metro (SCMTD) buses will not travel onto campus during a labor action. As in the past, Metro routes serving the campus (10, 12, 13, 15, 16, 19, and 20) will load and unload passengers at transit stops adjacent to the Main Entrance on Bay and High Streets, and passengers will walk onto the campus to board Day Shuttles. Traffic may be congested, so you may wish to allow for additional transportation time.

It is critical that employees understand their rights, and the rights of the university, when participating in a strike or honoring a picket line. The University of California expects that all faculty, staff, academic, and student employees meet their normal obligations to the University in the event of a strike. Those who do not report to work will not be paid unless prior approval for a legitimate absence has been granted. Those who call in sick on the day of a strike are required to provide documentation from a health care provider to receive approval for the absence. Please note that withholding pay for an unexcused absence is not a form of disciplinary action, but a practice consistent with our longstanding personnel policies and procedures. However, employees with unexcused absences may also be subject to disciplinary action.

A contract with C.N.A. is being negotiated through the UC President's Office. The President's Office assures us that the university is bargaining in good faith and that strikes initiated prior to the conclusion of bargaining (including the impasse process) may not be legal.
